Mr K makes a good point about this situation possibly not rising to the level of eminent domain.

Since you haven't actually moved in yet I think the simplest method is just to give the landlord written notice that you are not taking the place because of the misrepresentation and that the landlord is unable to provide you the property as you bargained for it.

I suggest doing that now.

If you've paid any money to the landlord, demand its return.

If you don't get it, sue.

But the starting point is written notice of cancellation.

Paragraph (1)(a) looks like your way out.

Paragraph (3) says the provision "shall be liberally construed." That tells me that a judge is likely to look favorably upon your cancellation should you end up in court.

PS: The landlord might be all smiles now but be prepared for things to get nasty once you give him written notice.
