    Work HARDER with them to resolve it and then have them withdraw or kill the case ASAP. One thing you do not want is a public record on your credit report. It will stay for 10 years minimum but can be renewed in most cases. Get any settlement agreements in writing and fully executed.

    it is very unlikely they will withdraw the suit if they have already filed it. More likely they will agree to a stipulated judgment in an agreed upon amount.

    I don't know.

    Pay 100% of the debt right now plus the creditor's costs and OP might be able to get a dismissal out of them.

    Um, I suppose so


    dfwhatever was speaking of a settlement though. If one walks into court with all debts and costs paid, the court should not be entering any sort of judgment.

    I don't have 100% of the cash to pay the debts balance, I called them today and offered them half, and then pay the rest off within 3 months, they said they would get back to me and let me know if that can bee approved, so if I do that and im still served then why go to court, my credit has been trashed due to medical bills already. and if I don't do anything they get a default judgment and im still going to offer them the same deal.

    but if they get a judgment, there are usually other means available to them to collect on the judgment and the judgement will remain on your credit report longer than anything you currently have on your credit report now.

    Very good point, thanks to everyone for the great answers, Also I don't think that this came up, but if I don't appear for the court date is there a warrant issued for my arrest after the default judgment ?? Thanks.
