    Default How to Get a Copy of a Divorce Record

    I have been trying to get the records of a divorce which took place in Virginia in 2005 and having a hard time of it. I went to the Virginia Courts website but could not find the record. I then went to another website and it instructed me to write to the Virginia Department Of Health Vital Records Division with my request. I wrote them, and this was their reply: Divorce records are not available to the general public until 25 years after the date the divorce was final. We will not be able to help you in this matter. I've never heard this before, does this mean that all divorce records in VA are sealed for 25 years? I've heard of certain documents in a divorce file being sealed, but not the entire file being sealed. Does "not available to the general public" mean that an attorney could access it and get me the documents if I paid him whatever fee he would require for such a service?

    I don't think you understand the 25 year thing. The vital records are available for 25 years after the event but only to immediate family members (mother, father, husband, wife, child, brother, sister and grandparents). You would need a court order to obtain the records perhaps through a law suit if you are not the immediate family.

    I am considering bringing a suit against one of the parties in the divorce, the woman, and I have reason to believe that there is information in the divorce file about her that would fortify a suit against her. Would I be able to get a court order in advance of filing the suit, or would I have to file the suit first?

    If the court has no record of that person's divorce, getting a court order isn't going to find it.

    Is it possible that she was not divorced in Virginia?
