    Default Billed for Services Incurred by Adult Son Who Does Not Live with Us

    My question involves collection proceedings in the State of: Texas

    My son will be 21 this August. Last November (2013), he went to the emergency room. He incurred a pretty hefty bill. We are now receiving the bills from the hospital and the company that ran the blood tests along with a few others. My son was 20 at the time of the services. He did not live with us nor did we know he went to the hospital. We only found out when the bills started coming. The hospital and the other companies tried to bill an insurance company that we had about 7+ years ago before my husband changed jobs. Of course the insurance claim was denied. Now they have listed my husband as the responsible party. Neither of us have signed anything taking responsibility for the bills.

    My husband went up to the hospital and spoke with the billing department. She assured him that the information would be changed and my son's address would be updated to his current address. That was in January of this year.

    We are still receiving multiple bills including the hospital bill and they are still in my husband's name and claim he is the financially responsible party.

    Here are my questions:

    1. Are we responsible? (I do not believe we are.)

    2. If not, what would be the best course of action to take to have the information corrected? A letter maybe?

    No, you are not responsible. This is an error on the hospital's part. You need to be assertive in resolving this with the hospital.

    Unfortunately, the billing department people really don't care what you tell them.

    You are probably going to have to go higher up the food chain to get this resolved.

    You might even need an attorney at some point.

    Better check your credit reports to make sure it doesn't appear as a delinquent account.
