    Default How Does Uninsured Motorist Coverage Work

    My question involves an injury that occurred in the state of: FL

    I was involved in an accident (not at fault). The other driver has 25k in BI coverage. I have additional uninsured motorist coverage. I know that the 25k in BI coverage has to be exhausted prior to using UM coverage. If the other person's insurance company settles for the full 25k, does my insurance do an accounting of how the 25k was spent before paying out any UM claims? How are UM claims usually handled?

    What you refer to in your case is Underinsured Motorists Coverage. There's a bit of a difference between that and Uninsured Motorists Coverage, but we'll let that go for now.

    The way both coverages work is that your insurance company becomes your adversary and you'd be required to prove the value of your claim just as you would have to the other insurance company if the other insurance company had enough limits.

    Your insurance company wouldn't "do an accounting" of how you spent the first $25,000 but would require you to submit documentary evidence of all of your damages, i.e. medical expenses, loss of earnings, other expenses, pain and suffering. The actual costs (specials) would likely be easily quantifiable but the pain and suffering portion that you claim would likely result in a dispute with your own company that would probably have to go to arbitration or mediation, depending on the terms of your policy.

    In other words, you don't just give your insurance company a number and expect them to write a check.
