    Default Can I Walk Away from a Car Deal Based on Delays in Delivery

    My question involves a consumer law issue in the State of: New York

    Hi, i recently purchased a used car from a dealer and got approved for financing. I did not put any money down. I arranged for my current car to be traded in. I signed the financing papers and was told that the car had to go through they're 120 point inspection process. Long story short its been a month and i still do not have the car. First it was that they had to get a warranty for the engine because the ford dealer did not want to cover a land rover engine and now he is telling me that the car has a check airbag light that wont go off. What makes me nervous is that the ford dealer could not fix the problem. they had to send it to a land rover dealer and thats where we are at now.

    I wanted to know if it was possible to just walk away from the deal. To conclude i signed financing papers, car trade in papers (still have my title and car) and never took possession of the car. Your advice and input will gladly be appreciated. I also would like to know what would you do if you were in this situation. Thank you and have a nice day.

    I wouldn't just "walk". The assumption if you don't do anything that the contracts are still in effect. You should walk into the dealer (I'd also put it in writing) informing them that the slow delivery is in breach of the contract and you want out.
