When mom went to the E.R., it's safe to infer that mom signed a contract agreeing to pay any bills sent by the E.R., because that's what E.R.'s have parents (and anybody else who they can get to sign on the dotted line) do.

CRAs do a pretty good job of investigating when a dispute is filed. If no dispute is filed nothing happens and the entry stays on your report. It behooves the OP to file a dispute. It cost nothing except some small fees for the copies of the checks.
Sure. But, again, CRAs don't remove accurate information even if you dispute it. If the explanation is, "I didn't pay the bill, but my husband should have paid it," that's not going to fly. (It could be added as an explanation for the entry on the credit report, but nobody pays attention to those notes.)
