    Default Caught shoplifting at Nordstrom's

    i have a question if anyone know's, last month my friend and i were in Nordstrom's, we had taken two bags in the store from our car, walked in and took a couple shirts each, and two bracelets, walking out, my friend was stopped and escorted back in by security, as i was infront of him, security yelled, "sir did you take anything?" i of course replied, "no". they then said, "then keep walking." I wasnt from around the area, so i got in my friends car, drove across the street and emptyed the merchandise in the parking lot. 10 mins later i got a text from my friend stating, "if you come in, since this was our first offense they will let us walk and split the value of mine." keeping in mind that the value of his was 590 dollars, which is Grand theft. As i was stupid, i went back in, and was arrested from the moment i walked in, they asked what i had taken and told them two bracelet's. the value they assumed was $350(since i didnt have them on me). They asked where the merchandise was and I told them, they somehow couldnt find it there though. Later, after going to jail, i was charged with Petty Theft and my friend was Grand Theft. Nordstrom's sent me a letter requesting $500.00 to release civil liability, so i paid it. My friend went to court got 5 days of caltrans, $1500 fine and probation. The next week, I went to court, they tried charging me with Grand Theft and Petty theft, my question is, (now that im fighting the charge), can the DA charge me with Grand Theft if they viewed the security tape and saw my stealing more? They never caught me in possesion with anything, and if they got the merchandise back, it was after the fact of me admitting what i took to Nordstroms, and Nordstroms never said anything about any more merchandise. I just dont understand what could be happening? Please let me know if you have any clue.

    Short answer yes! They also have your own statements made in Loss Prevention office

    Wait, so if you're caught with a friend?
    They try charging you with what you and your friend took together?


    Because for me it would be a felony.
    Sepereately, for us it wouldn't.


    Oh my gosh. 3 months have passed without a court date.
    Isn't a year the maximum time to prosecute?

    As I remember C.P.C. (California Penal Code) if you entered with empty bags and concealed merchandise, you committed Commercial Burglary which is a felony (it shows specific intent). I'm surprised the DA hasn't dropped that one on you, if you participated with your friend you can be charged for the same crime. Oh yeah.....and you spilled your guts to LP, can you say "I'm Toast"??

    Well we entered with bag's from other stores with bought merchandise, my question is, We never admitted or spoke of me taking anything besides the bracelet's, so the only way the DA could have found out is ethier, one of the cop's went and picked the merchandise up after the fact, and then reported what was in the bag, or they watched the security camera. But in the bag, like i stated above, there was other merchandise from different stores. I thought they had to catch you in posession with the merchandise to charge you with it? And why didnt Nordstrom's contact me re:the other merchandise recovered then? Tommrow I go to court with my Public Defender?

    You done dude ok they video they have your statements and your parteners statement. Find a Lawyer your going to need one
