i have a question if anyone know's, last month my friend and i were in Nordstrom's, we had taken two bags in the store from our car, walked in and took a couple shirts each, and two bracelets, walking out, my friend was stopped and escorted back in by security, as i was infront of him, security yelled, "sir did you take anything?" i of course replied, "no". they then said, "then keep walking." I wasnt from around the area, so i got in my friends car, drove across the street and emptyed the merchandise in the parking lot. 10 mins later i got a text from my friend stating, "if you come in, since this was our first offense they will let us walk and split the value of mine." keeping in mind that the value of his was 590 dollars, which is Grand theft. As i was stupid, i went back in, and was arrested from the moment i walked in, they asked what i had taken and told them two bracelet's. the value they assumed was $350(since i didnt have them on me). They asked where the merchandise was and I told them, they somehow couldnt find it there though. Later, after going to jail, i was charged with Petty Theft and my friend was Grand Theft. Nordstrom's sent me a letter requesting $500.00 to release civil liability, so i paid it. My friend went to court got 5 days of caltrans, $1500 fine and probation. The next week, I went to court, they tried charging me with Grand Theft and Petty theft, my question is, (now that im fighting the charge), can the DA charge me with Grand Theft if they viewed the security tape and saw my stealing more? They never caught me in possesion with anything, and if they got the merchandise back, it was after the fact of me admitting what i took to Nordstroms, and Nordstroms never said anything about any more merchandise. I just dont understand what could be happening? Please let me know if you have any clue.
