    Default Can a Debt Collector Threaten You With Jail

    My question involves collection proceedings in the State of: Illinois

    My grandmother from North Carolina received a phone call earlier this month from an "agency" telling her that are trying to contact me in regards to a complaint.The guy name was Jeff Donahue and had left his number along with a reference number. I called and the person who answered directed me to their legal department.When the person got on the phone (wasn't the person who left the message with my grandmother), he stated that a payday loan company in texas performed legal actions against me for breach of contract and fraud. I told him I had no knowledge of the payday loan company that's located in Texas, eventhough i was stationed there almost 4 years ago.He kept saying if i didn't pay then I will be going to jail. Initially I thought it was something my ex-husband did because he did things like this in the past. So, I paid $55.00 over the phone and scheduled a payment arrangement. But upon looking up the phone number online,i seen that the same phone number i called has a list of complaints similar to mine.So I deactivated my bank card and my bank is sending me another one.Plus I filed a case with my bank's fraud department so I can get my $55.00 that I paid to the "agency". I also found out they called my grandmother's home again recently,but they left a voicemail. Should i obtain an attorney or let it go and ignore any contact?

    it appears you are not certain you were not liable for the debt. Due to that, I would be very cautious of your actions.

    as to whether you go to jail or not; not up to the creditor and even if there was a crime committed that would result you going to jail, it is not up to the creditor to prosecute it nor control the sentencing.

    there are some situations when dealing with payday loan companies that can result in criminal charges. Due to that, I would do some serious thinking to figure out if you really might be liable for this debt.


    to start with, I would suggest you contact the court clerk in any of the counties you lived in in Texas or did business in where this situation might have happened and ask if there is a warrant for your arrest.

    I know I haven't dealt with this company myself,that's why I'm saying should I be concerned.My ex-husband put my name in things in the past so that's why I was concerned. I don't see any judgements or the "creditor" listed on my credit report.I don't have any warrants out for my arrest since I just recently had a criminal background check for my new job.

    the fact your ex used your name illegally before would surely give me cause to be concerned but you say you have not done business with this company before. Do you mean the collection agency or the check place? and realize that the formal business name used in lawsuits is not always the name of the business you see on the front of a building.


    if the debt is not yours, I would report the agency to your state's attorney general as well as the AG in Texas and North Carolina. It may go nowhere but then again, in what sounds like a scam, it might.


    I would keep an exceptionally close watch on my credit report and any bank accounts.


    Other than that, I believe I would refrain from any communications with them, at least until you get something in writing.

    The name of the "agency" that's been contacting my grandmother and myself is called Capital Services.I can't find them on google or anywhere.But once I typed the phone number I was given to call, that's when I seen the list of complaints from others about that number. The company they called about, Cash Store, I seen in Killeen while I was stationed there, but never dealt with them. So, I've never dealt with either company. I already filled out a complaint this morning with the FTC.I currently reside in Illinois and have been for almost 4 years now. They claimed they sent papers about me being charged to my previous address (I no longer live there) and to prevent from getting charged and arrested I needed to settle the debt. It was "originally" over $2,000 but lowered to not include the extra charges (which is odd).

    And another odd thing is that when they took out the $55.00, it was under a different name, "Quest Capital". Not "Capital Services" as what they claimed who they were.
