My question involves landlord-tenant law in the State of North Carolina.
I signed a lease yesterday to move into my new home. I paid my 700$ deposit, 700$ for the first month rent, and 138$ pro-rated starting yesterday till the end of the month. I signed a consent form for background and credit check 3 days ago.
Today I received a call from the landlord saying that he had to return my money and couldn't rent me the house because I have a Marijuana charge from 3 years ago. We have already signed the lease and I have paid for the house. Is this a breech of contract on his part? Is he allowed to do this? If he was going to refuse the property because of background check wouldn't he have to do that BEFORE he signed the lease and received payment? Thanks for any help.
