    Default Do I Need to Disclose Accident Information to My Health Insurance

    My question involves an injury that occurred in the state of: California.

    My son was at a trampoline park and broke his leg. The park has a rule that only one person can jump in each square. My husband was jumping in one square, my son in the one next to it. Being two years old, he wanted to go to his daddy, so he jumped into my husband's square at the wrong time and broke his leg. We don't blame the park, we know our son wasn't following the rules, and we signed those liability waivers anyway. So, my son got his cast and all the medical care we needed, and I just got a form in the mail from my health insurance. They want to know the name, location, and insurance information of the trampoline park. My friend told me not to fill it out, because then the health insurance will deny payment for his medical care, and say that I need to sue the trampoline park to pay for my expenses. So... do I need to fill out this form? What law would require me to disclose the park information to the health insurance company? Can health insurance deny payment because it is the "fault" of someone else?

    Your "friend" is telling you to commit fraud.

    Yes, you need to complete the form. I'm not going to dig through the statues to prove it to you but when you signed a contract with the insurance company, you agreed to provide them with the information they require. It's very unlikely that they will deny payment - more likely they will pay the claim and subrogate against the park's insurance if the park has any liability.

    Oh, and if you don't complete the form? That's when they'll deny coverage.

    cbg is correct. Your insurance company will not pay your sons medical bill until they receive that information, so you better get that information to them before the hospital starts mailing the bill to you, and then a collection agency.

    I agree, just tell them what they want to know. You need to complete the form and you definitely don't want to get caught in a lie or an omission. It's probable that they are going into what's called subrogation in which case they will pay the claim then sue the park for reimbursement. Either way, it's in your best interest to work with them.

    I'm the insurance guy and I concur with the other responses.

    Fill out the form because your coverage has a cooperation provision and a right of reimbursement/subrogation provision.

    What the insurance company does with it is up to them.

    My husband and I singed a loan for a car for my parents. . My 17yr old brother was driving the car drunk and ran jnto a house. No one was injured only a wall and a window. The insurance company is harrasing my oarwnts to lay thousands of $ exaggerated amount and is way more than they can aford.. parents advise from lawyer was to declare bankruptcy. . If they do will the insurance com come after us or what can I do to get out of this mess id I wasnt deiving and had no idea brother was drivinf rhe car?

    You should start your own thread instead of posting in an old one.

    So what you are telling us is you and your husband bought a new vehicle that you have a loan on. The vehicle is registered and insured in your name but you let your mother and father drive the vehicle.

    Assuming you have full coverage because there is a loan on the vehicle, then why is it that your insurance company is denying the claim? Are your mother and father listed on the insurance policy and do they live at your address?

    Whom gave permission for your 17 YO brother to operate the vehicle?
