    Default Work Injury Causing a Compression Fracture

    My question involves workers compensation law for the state of: Connecticut

    Good Morning,

    I injured my back on April 14, 2014 doing my job, which is very physical. I worked a few days after that thinking it was just a muscle pull and it would work itself out. I did notify my boss the day after though and someone from the company contacted me. I work in the field so we usually communicate by email or phone. Anyway, the injury occurred on a Monday, by Friday when it wasn't better, I went to see a doctor. They believed it was a muscle problem and I had physical therapy sessions twice a week and I went back to work with restrictions.

    After a month of this, the pain was not letting up so they sent me for an MRI, which shows a compression fracture. My restrictions were changed - downgraded so that essentially I can't perform any of my regular duties. On the advice of my employer's insurance company (nurse case manager) I sent the activity report to my boss Thursday morning and asked what I should do as far as working goes. He didn't respond so I contacted him again on Friday, still no response. I didn't go to work Friday because I was waiting for him to tell me what to do, if anything. I haven't heard anything from him or anyone from the company. (their medical director had been communicating with me when the incident occurred). I should mention that ever since this happened my boss' attitude toward me changed and not for the better.

    Now I don't know what to do about work. I will see an orthopedic next week but I have no idea what's going on with my job. It's seasonal and will end probably the first week in July anyway. I worked for the company last year and was asked to return this year. Never had any problems and performed all my duties and many compliments as to my performance.

    Any advice?

    You don't need your boss' permission to take care of your injury.

    If it prevents you from working, don't work.

    Call the insurance company's WC claim rep and tell him/her that you are filing for weekly benefits and get the paperwork started. Do not rely on phone conversations.

    If you get any flack from the employer or the insurance company, contact the CT Workers Compensation Commission for assistance.

    connecticut comp laws do not require that your employer provide modified work or create a job for you.
    ADA laws do require a discussion about reasonable accommodation.
    if you can find work within your restrictions you can accept it without jeopardizing your claim.

    Thank you for the responses. I guess what bothers me is that no one has contacted me to tell me anything - come to work light duty, don't come to work we don't have light duty. I didn't go to work on Friday by my own decision knowing I couldn't do the basic requirements and I guess I'll have to make a decision about Monday as well. I suppose I could perceive this as a termination or they could perceive this as a now show/quit. It would be nice to know.

    Tuesday morning, pick up the phone. Call your employer. Ask them if you should report to work. The last thing you want is to be termed for a no-call, no-show.

    Yes, I will call the only other person in the company that I know of. It's strange to me that when I first got hurt, I looked through the employee handbook for the procedure on what to do, who to report to, etc. Nothing. Only safety measures on how *not* to get hurt. When the person from the company called me, they didn't even have a designated place for me to go to be checked out. I chose the clinic. The only thing she wanted to know was if I rested over the weekend would I be better.

    I was really surprised because this is a HUGE company and you would think they would have procedures in place for such injuries. This job is nothing but strenuous and I'm surely not the only one who ever hurt their back. The lack of response from them is really strange too.

    Don't call "the only other person that you know of". Call either HR, or your immediate boss.
