    Default Military Active Duty Divorce with Dependant Moving Out of State

    My question involves a marriage in the state of: California
    I am active duty air force and my unfaithful husband and I are persuing a divorce. He wants to move out of state to Florida on 6 June 2014. He is currently unemployeed and is going to live with a friend. He wants me to pay his plane ticket and for the divorce. He is going to do it it amicably and does not want to have this go to court. My question is that if he goes to Florida can I still file for divorce and then have the papers served to him in Florida or does he have to also reside in california.

    Yes you can - but unless there are kids involved, I see absolutely no reason why you should have to pay for anything.

    He's a big boy - let him pay.

    There's no kids, no mutual assets or debts and we've only been married for 5 months. He has no job and is unwilling to get one. I'm kind of stuck with him.

    In that case, if everything is agreed, it shouldn't be complicated or costly.

    He's not even going to consider contributing financially, is he? That being the case, give him a huge beatific smile, and have him served.

    If those are the facts, do a summary dissolution, both of you sign, you pay 1 fee and it'll be final in 6 months. No one even needs to be served, you simply fill out the forms together and both sign.
