My question involves law in the state of Montana. The time was 2 months ago, I am 19 and my girlfriend was turning 16 in 7 days. We had sex 7 days before her birthday. I know this to be the time of conception because we haven't had sex since then and her pregnancy test came back postive. Would they ever be able to prove that we didn't have sex on or after her birthday because it is so close to the time she would be able to consent? Is it likely that they would press charges for having sex 7 days before the age of consent if she chooses to have a baby? Could they prove this beyond a reasonable doubt?? If one parent wants to press charges and the other doesn't, and the one who doesnt want to press charges has custody of her, could i still be charged? PLEASE HELP.
