The lease states that I am not allowed to sublet, that's why I suppose he listed him as a guest, but realistically who is going to allow someone to live off of them for free without charging them?
so you are in violation of your lease. I think you need to hope your landlord doesn't figure out you are subletting because you cannot cure the matter fast enough to avoid getting evicted yourself.



I don't want to get evicted myself for having a subtenant, but I think that he is back on his feet and I see no reason for him being here other than wanting me to move out first so he can have the place to himself and not have to pay another security deposit.
what makes him think he wouldn't have to pay a security deposit. He cannot just continue your lease/tenancy. If you leave, the landlord would have to pay you whatever portion of your deposit you deserve. If the "guest" wants to enter into a lease or rental agreement with your landlord at that time, he would have to pay whatever deposit the landlord required of him.
