My question involves landlord-tenant law in the State of: Massachusetts
My issue is that we have a mouse problem. Simple, right? One of my roommates, Bob, went out and bought glue traps. (No one knew he did this). Bob proceeded to place the traps in the kitchen, where the problem is at its worst.
I get a knock on my door that night when I come home from work and it's Bob telling me that I cannot use the oven. This alarms me as I am in culinary school and need an oven. Bob tells me that he had placed a glue trap IN the oven and that Mark came home from work and went to make a pizza. And Mark, not thinking that he should check the oven, preheated the oven for his dinner. The glue melted everywhere and now the oven is unusable.
I ask Bob what would make him put a glue trap into the oven and he says to catch mice. I then ask Bob to explain how mice get into the oven. Bob has no answers.
My question is this: I know my landlord is wicked cheap, but I don't want to be held responsible for this issue down the line. So do I call my landlord and tell him that Bob told me the oven is unusable? Do I explain the situation to my landlord - or do I act dumb and just I don't know what happened? Who is responsible for this?
We're all tenants at will, there is no lease.
