My question involves criminal law for the state of: NY, federal
Hello, I am a new physician and I am applying for for a DEA registration number and there is a question on the application that asks:
"Has the applicant ever been convicted of a crime in connection with controlled substance (s) under state or federal law, or is any such action pending?"
In 2000 I was arrested for possession of a controlled substance (misdemeanor - 220.03) which was reduced to NY Penal code 240.20 for which I plead guilty and paid a fine. I was never in trouble before and I had no other incidents. I was told it is a disorderly conduct violation and not a crime, so can I answer this question as no? I don't want to lie or omit anything but I was always told that this is a violation and not a crime in NY.
Thank you in advance
