    Default Can a Child Get Emancipated Due to Educational Neglect

    My question involves juvenile law in the State of: Arkansas
    My mother and father are separated and I've been living with my dad for two years now. At the beginning of my freshman year of high-school, only about 3 months in he pulled me out of school to home-school me, and on December 16th of my freshman year the woman that was homeschooling me had to stop and after that my dad never put me back in school. He decided that it would be best for me to just take the Standardized in April, so from December to April I was in no form of school. I took no tests, nothing. Also around January he stopped letting me leave my house. On February 1st, my neurologist sent me to a psychologist who told my dad that if he didn't let me see my friends or go out i would develop depression and very possibly become suicidal. She also told him that i needed to go to therapy, he refused both. I'm 15 and in 5 months I will be turning 16, my mom is willing to sign the emancipation papers for me, I'm not sure if my dad will. I can get a job and pay for my own apartment, if necessary, i'm wondering if i can live with my grandma or boyfriend and get emancipated, i will still have a job and i will be going to school, i just want to know if i HAVE to get my own apartment on my own or if i can have a roommate. and if under my circumstances i can get emancipated

    Sweetheart, if you had read even the most basic information about emancipation in your state, you would know that the minimum age to be emancipated in Arkansas is 17. No emancipation for you for at least 2 years.

    Yes, I know minimum age is 17 in Arkansas, but I had a lawyer say that because of the situation that there was a chance and I could also move to south dakota where minimum age is 16.

    No, you didn't. The law does not say, you cannot get emancipated until 17 unless you have a really, really good reason (which, btw, you don't) and then you can emancipate younger; it says, you cannot get emancipated until 17. What's more, minors who are being treated for depression and suicidal tendencies are not going to be emancipated no matter how old they are. And since you can't legally move out of the house without permission until you are already emancipated, which you're not going to be in Arkansas, how exactly do you intend to move to South Dakota?

    No lawyer told you any such thing. You're not doing your credibility any good when you make up stories like that.

    Amazing isn't it, the number of teens who have already talked to a lawyer, yet still find the need to come here and argue about the same topic. If you've been talking to a lawyer, then go talk to that lawyer again; and ask them what they've been smoking.
