My question involves criminal law for the state of: Georgia
Hello. I am new to this forum and there is no way to make this a short question. I will try. On Feb. 22nd I found out that my Daddy (a good man, very well thought of in our community, good husband and father) had been molesting his next door neighbor. I live near by also. I confronted him when I found out and he was enraged. I was told this by my brother. He was concerned and had known for a while. The neighbor is 12 years old and I realize this does not matter, but she did not look or act it. My daughter who is 9 was good friends with the 12 year old. The 12 year old and her 9 year old brother were "home-schooled" but I never saw signs of any schooling going on. Both kids were outside all day while their Daddy was at work and their Mama slept all day. My Daddy had recently been diagnosed with PAD and had to take medical disability. This initially began with him just making sure neither of these children were ran over or kid-napped. He basically watched after them because they had no adult supervision. I have never known my Daddy to EVER touch a child inappropriately. This was a nightmare when I found out. I questioned the 12 year old and she laughed when she told me that it had been going on for 8 months. I was shocked! I didn't know what to do.
On March 3rd a friend of mine called from Sheriff's dept. An investigator wanted to talk to me about my Daddy. I asked her about what and she said for me to just stop by when I could.
I found out from investigator that an anonymous text had been sent to her and someone from our church called to see if allegations were true. I told my Daddy and brother what was said at Sheriff's dept. My daddy went crazy. He was a recovered alcoholic for over 20 years but started drinking again. He threatened to kill himself for 3 days before he finally did. He would only talk to my brother for the days after the allegations were made and told my brother if he was going to kill himself he would call him. My brother called me on March 6th from his job and said his phone had died and he just plugged in and there was a missed call from our Daddy. He tried several times to call him back. I was at our local pharmacy (small town) and called home. The coroner and sheriff were there. Daddy had driven to a rest stop and shot himself in the head. I was DEVASTATED beyond words. I screamed his name all the way home. By the time I got there the word had spread and people came from all over. It was like a bad, bad dream. He left a small note saying how sorry he was and he loved us all. He said this was the only way he knew to make it better. Needless to say we are still grieving.
My brother (29 years old) suffered the most before his suicide and after. He had to listen to him threaten suicide and then he missed the call. My daddy was good friends with our Sheriff and would have committed "suicide by law enforcement" had we called them.
As a side note, my daughter without any prompting from me brought me a note. She said the 12 year old told her she had sex with a boy named Aaron and had a miscarriage. Not sure if true but hate that I let my daughter play with a girl who had knowledge of sex and was talking to my little girl about this kind of thing.
Long story short. On April 11th the next bomb dropped. The Sheriff stopped by the house and we thought it was just a friendly stop by and check on us visit. He informed us that my brother was arrested and in jail for 3 counts Statutory Rape and 3 counts Child Molestation (no touching, these were texts initiated by 12 year old before SR occurred). My brother admitted to the investigator what he had done. He was drunk each time (I know that doesn't matter). I really think he suffered from PTSD after Daddy. He was in jail for 3 weeks before we could hire a lawyer to lower his bond. He was banished from our county and is living in a neighboring town.
So basically my question is this: will the DA and judge take into account the WHOLE story? My brother has NEVER shown an interest in young girls before just as my Daddy had not. This was the same girl. Any advice appreciated. No judgments please. We are suffering enough. I hate to see my brother go to prison for years. Both of these men were decent men with hearts of gold. Never a suspicion of anything of this nature.
