    Exclamation Texas Law of Emancipation

    My question involves juvenile law in the State of: Texas. I'm 15 years old and will be turning 16 in June. My house is unfit for me. We have 5 other people living there,no food,always fighting,underage drinking,sexual use,underage sex with a 38 year old and a 17 year old,I don't have a room,and cps is already involved. I'm getting a job this summer,already having a place to stay,and doing volunteer work. At this moment I'm living with my friend because cos has put me there. Once I get my job I will be paying rent there.What's the best thing I should do,am I on the right track,and I too young,please help me.

    There's not a prayer that you are going to even be considered until you are 17 (or perhaps if you are ALREADY self supporting independently living at 16).

    Despite what you thought you learned about the word in eighth grade history class, emancipation is not a means of escaping parental enslavement. It's legal recognition of an independent minor that needs relief from certain things like not being able to sign contracts.

    We don't turn abused children out to live on their own. We find other custody for them. I've got news for you kid. Not having a room is not abuse. CPS will make a determination. If you think they are not fully apprised of your situation, you can talk to them, a school counsellor, or talk to the state hotline at 1-800-252-5400.

    I'm not living with my father at the time. Cps is already doing their do. I live with my friend. My father is not a good one. He doesn't do anything and is worthless.

    Under Texas law the minimum age to be emancipated is 16 you do not qualify at least until then.

    At 16, you can be emancipated ONLY if BOTH of the following are true; (1) you are living independently of your parents and (2) you are SELF-SUPPORTING. Self-supporting means that YOU have the means to pay, without assistance, the full market rate for rent, utilities, food, clothing, medical care, transportation, insurance, school fees and supplies, staples, and all the other incidentals of life. This will include showing the judge your budget, your paystubs, rent receipts, utility bills, etc.

    Emancipation is NEVER granted on the basis of how "good" your parent or parents are. On the rare occasions that emancipation is granted, it is granted on the basis of the minors PROVEN ability to financially care for themselves.

    Living with a friend doesn't qualify you for emancipation. But if you're already living elsewhere, what do you think emancipation is going to do for you?
