    Default Delay in Issuance of a Federal Tax Refund

    I'm a California resident that filed the simplest possible (single, no claims, no deductions, don't owe irs anything) completely clean federal income tax return for my 2013 wages electronically and exactly as reported on official W-2 form from my sole employer for that year and have been delayed over 3mo in receiving my money. Timeline;

    Jan 31st - Electronically filed through TaxAct
    Feb 5th - Accepted by IRS (no status shown via wheres my refund tool)
    Feb 24th - Letter received claiming a review is needed, allow up to 60 days for response
    April 25th - I reached IRS since 60 days have passed and no response via phone, email or mail. I am told to send in supporting documentation and allow up to 45 days.
    April 26th - I write a letter, provide my official federal copy of w-2 form, copy of my return and employer contact info and certify mail it to address given over phone
    May 2nd - I call back to see if response is given and lady says she is putting a referral to that department.
    May 10th - Still can't see a status posted on the Where's my refund tool and I'm sure as heck if I call i'll be told to wait 45 days and i probably shouldn't expect a response from them or money any sooner as you can see how they ignored me in the first place.

    Has anyone else had this issue and is there anything else i should do to get MY money..?

    I've had an issue with the IRS once that was not resolved by either the field office or the people on the phone. Someone at the field office actually recommended I call these people and they were extremely helpful in resolving the matter. Wasn't overnight, but it was definitely within a month or so and they got much further than I did. Call them up.

    It sounds like someone used your SS number and filed for something fraudulent. They are investigating.

    In some cases the IRS will delay issuing a refund until they receive the W-2 master file from the Social Security Administration so they can verify what you say your wages and withholding were. If the amount withheld for federal taxes is generating a very large refund, I would suspect that as a probable cause. The Taxpayer Advocate's office can be helpful, but they will want some evidence that the delay is causing you some hardship. Something like a pending eviction, utilities about to be turned off, etc. It wouldn't hurt to file a form 911 though. That can at least get someone to look in to what the issue is.

    Me and my wife found out this year 2014 that our federal refund was split between us and my child support arrears. IRS said Wisconsin is a Community Property State. The child support arrears is my obligation. Why can child support take half of our refund if my wife is not obligated. Thank you. Derek

    When you file a return in a community property state half the refund is considered yours and half is your spouse's. So your wife got her portion of the refund because the past-due child support was not her obligation. Your portion of the refund was diverted to cover your defaulted obligation. What part of this is confusing to you?

    Did you file an injured spouse claim with your return (form 8379)? If so, that would explain the long delay. The instructions to that form explain that it will take MUCH longer to process your refund.
