My question involves landlord-tenant law in the State of: Minnesota
I have a holdover tenant that is on a month-to-month lease with rent due on the 1st of every month.
Tenant notified me by phone on the April 20th that their last day is May 18th and then by writing on a letter that was postmarked April 24.
I told them that rent for May should be for the entire month. They sent me a prorated rent through the 18th using 31 days and not 30 days.
Am I entitled to use their security deposit for late fees and the balance of rent due for the entire month. I have nothing in our previous lease agreement regarding prorating rent.
