    Default How Long Does an Employer Pay an Injured Worker's Health Insurance Premiums

    My question involves workers compensation law for the state of: California

    I have a client with a hotel business ,they have a health plan with Blue Cross . They have an injured employee that has been out of the work place for over 6 months now. Looks like the claim will be staying open for a while. How long are they obligated to pay their health insurance premiums or are they obligated at all.

    They are obligated by law to pay the health insurance premiums for the 12 weeks of FMLA, if FMLA applies. After that, or if FMLA does not apply, it depends on what the health insurance plan document says.

    Do you know how long they have to keep their job position open while they are out on a workers comp claim

    If FMLA also applies, 12 weeks.

    If there is a state version of FMLA, the amount of time the state version says.

    If FMLA does not apply and there is no state version that does, the amount of time that they would allow for a non-workers comp claim.

    If there is a state that dictates a particular length of time for workers comp claims that is separate from non-work related claims, I have yet to hear of it.
