    Default Buyer Claimed She Received an Empty Box

    My question involves a consumer law issue in the State of: CA

    We sold a $6000 bracelet on eBay. The buyer claimed that the box was empty through means that it was tampered with. We called Fedex and they interviewed the driver which said that there was nothing wrong with the packaging. Fedex is denying the insurance claim. So far, I've filed a claim with Fedex. I will file the police report, I want to know if there's anything more I can do at this point. Any information would be appreciated.

    The buyer claimed that the box was empty through means that it was tampered with.
    what does that mean? Is it stating the recipient stated it appeared the package had been tampered with? If so, was the damage to the package noted on the FedEx delivery receipt? Does the recipient have pictures of the apparent tampering?

    I surely hope that the money wasn't paid through PayPal for your sake.

    There is a long standing scam when it comes to selling high end jewelry and watches on Ebay and other such small items of value. The buyer claims they didn't get the item or like in your case that the box was empty. How absurd. The next thing the buyer does is file a claim with PayPal. PayPal puts a hold on your funds and if you can't prove that the buyer did get the item, they reverse the transaction. And to be frank, you can't prove that they got the bracelet. So the buyer ends up with the bracelet and eventually the money refunded. The police may care if there is a pattern that has been reported but PayPal will not.

    Good luck because you will need it. I have been there and done that with Tag Heuer watches. The only way to send that type of merchandize is through a securities delivery firm. You send the item to an office in or near the city where the purchaser is and they deliver it to the buyer. Without proof of delivery (and I don't mean the box), you are xxxx out of luck. Sorry.

    Check out the buyer's stats on Ebay and see what the buying history is, the feedback they received. If you fine that this is a first time buyer that is not a good sign. The people that pull off this scam will establish a good buying record for small items and wait for the big one and then the account goes cold.

    You should be talking to Ebay. They can track the IP address of the purchaser and find out if they have multiple user names and if they have done this before.

    The buyer claimed that after she signed for the package, she saw that the package was compromised. She claimed that the package has been cut opened and was tape over it.

    I did received the money via paypal and unfortunately only insured for $1,000. She has no negative feedback and her feedback is over 600. I checked the ebay stat, she left 7 negative feedbacks for other sellers but ebay removed those feedback. I contacted those buyer, 4 of them get back to me that said she never paid.

    Since it's a lot of money, and fedex denied the claim. Can I pursue this further. I honestly believed that she has a bracelet. I shipped via fedex overnight AM delivery. There's very small window of anything goes wrong or tampered with.

    Yep, she has the bracelet because it is a hard stretch to think that someone would or could have known that something of value was in that particular box to cut it open and then tape it closed. That could only be the driver and he has already said that the box was not tampered with before delivery. How many packages does FedEx handle each day?

    Talk to Ebay and the police. FedEx is not going to help you here. And PayPal will just wait for the proofs.

    You have a problem in itself that it was insured for only $1000. Why would you insure a package you claimed to be worth $6000 for only $1000?

    and that was noted on the fed ex shipper?

    If Fedex denied the claim. Can I dispute or will they launch an investigation further? I filed the police report, what else they can do?

    Can I do that? It will be a chargeback through paypal. At this point, I want to hire some private investigator but not sure if it will be worth it.

    What do you think a private investigator could find out?

    You must have pictures of the bracelet since you posted it on Ebay. Any chance that you have an appraisal for insurance purposes?

    Consider contacting your homeowner's insurance company and see if the bracelet would be covered. It's a longshot but I would check.
