    Default How Can an I-193 Affect a J1 Visa Renewal

    Hi everyone,
    I am a french citizen, working in an american university. I initially had a J1 visa until March 2013 but my position got extended so I did all the paperwork and got my new DS2019, valid until march 2015. The university told me my visa end date was irrelevant, even if I wanted to go back home. I made the mistake of trusting them, and went back to France in september 2013. Trying to fly back to the US in october from Dublin, Ireland, the custom official told me my visa was not valid. Nevertheless, he gave me an I-193 to enter the US without a valid visa. He stamped my passport with a J1 class and a hand written note: "212(d)(4) waiver $585.00 fee collected"
    I have been in the US since, but now I would like to go home on vacation and I am concerned about this I-193 affecting my ability to get my visa renewed if I go to the US embassy in Paris.

    Does having this I-193 put me at risk that the embassy could refuse to give me a new visa until march 2015 ?
    Also, could this affect my chances of changing visa status, if my university wishes to keep me after march 2015 under an H1B visa ?

    I doubt that any one in the international office misrepresented the significance of the visa expiration date. I expect you misunderstood; you did not have to get a new visa stamping to remain in the US on the extension.

    Thank you for your speedy reply. I might have misunderstood. The exact same situation happened, though, within 2 month for another Foreign postdoc, that got the visa information from the same person.

    I did not get a stamp to legally remain in the US (to my understanding this is what the DS2019 is for) rather, I got it when I crossed the border control before boarding my plane in Dublin to fly back in the US last october.
    My issue is wether or not this might affect my visa renewal, next time I leave the US.

    If you believe you received inaccurate information at the university, you should have spoken directly to the DSO to report it once you returned. Most international advisers and staff members are very protective of their charges as well as the university. If someone was giving out incorrect information, they would want that addressed immediately.

    No one can predict with certainty the outcome of a visa interview or experience at the border even for individuals who do not have a problem in their past record. All you can do is be prepared with your documentation and truthfully answer all questions for the immigration officials.

    I did, as soon as I got back, and they did address it, actually.

    Thank you for your answer. So you are saying that having an I193 does not automatically disqualify a visa renewal ? That was my question, since I know, of course, that no one can guaranty the outcome of a visa interview.
