My question involves criminal law for the state of: New York
Hi,
Two days ago I was pulled over after a cop saw me smoking a glass pipe as I was driving off my college campus. The cop was nice enough to only give me a summons for criminal possession in the 5th degree. They took the pipe and the marijuana inside of it as evidence. My court date is in June, and I was wondering what exactly I should expect. I'm 19, and this was my first time being arrested for anything. They took my picture as well as fingerprinted me. According to NYS laws, this is considered a Class B misdemeanor, and I've read on various legal websites that the charge is either dropped in court or one year after the court date for first time offenders.
So what exactly should I be expecting in court? If the charges are dropped, will the mugshots/fingerprints still be on my record permanently? It's frustrating to know that I could still have a criminal record even if the case is dismissed. Also, how should I prepare for my court date?
Thanks
