    Default Does Child Support Go Up Based on Marriage

    My question involves child support in the State of: Tennessee

    My parents have custody of my husband's and I's children. i currently dont have a job but he works at chilis. He went to child support court and they issued him to pay $200 per child. And they found out that day at court that we were now married. I havent been to court yet over it but its coming up. My question is when they calculate payments since we are married and they both our children are they going to base it off gross income of both of us and only make us pay $200 for each child still or make us both pay seperately $200 for each child since we are married and i have no income? Thank you.

    You're saying he pays child support to you, even though you guys are married? Or is the child support paid to your parents?

    You posted this as a custody matter. Is this in fact a guardianship case? A child protection case?

    Marriage isn't really the issue. If you weren't the mother to your children, your marriage to the father would be irrelevant to his child support obligation.

    The fact is, you're the parent of these children and, as such, you have a duty to support them. The court has every right to say, "There's no reason you can't go out and get a job", and impute income to you based upon the fact that you are choosing not to pursue income despite your inability to earn a wage and to help to support your children.

    She's stating that her children live with her parents, and that both she and her now-husband have been summoned to court for child support proceedings.

    Yes my children live with my parents. And we were both summoned to court to pay. Will they make us pay jointly or separately
