My question involves an eviction in the state of: Michigan
Me: I am the main tenant of a house my friend owns. We basically have a verbal agreement that I am only paying for property tax and water bill (both being under his name). I have used my own personal funds to fix the house up, so that I might sub-rent extra rooms for cash income. With that, the rent I receive helps to pay for the utilities costs and amenities like cable; as I am only a part-time worker going to college. Another aspect is that the house in the city, has city sewage that requires root removal about every 3/4 a year.
Subtenants: My longest tenant has been living here with a 7 year old kid, since February of 2013, for $360/month, though I have never been paid more than for a week at a time, unless it was a lump sum for overdue rent. This was from an ad I put on craigslist, and did mention cable/internet would be included in rent. She also had me fill out DHS forms for Bridge card, which should make it more than verbal agreement at this point. She then had me allow a couple move in in January of 2014, when another room became available. The couple also had a baby within a month and I filled out a DHS paper for them as well based on $320/month. The first lady paid more because she had use of a second room for her kid. The guy from the couple is also the dad of the 7 year old kid. So when dealing with the situation they must be considered as one group. In both agreements there was no security or first/last month payment, just pay-as-you-go.
Situation: They pay in cash, I don't give receipts, and keep track of payments on a spreadsheet. After having enough with the drama, and having the kid destroy my computer tablet, I asked the lady to move out (and was trying to figure out how to also have the couple move out). Now no one has been paying me rent for the past month. I read I cannot just kick them out, and that I cannot stop electricity, heat, or water. I am now having to pay for these with what little money I make and cannot afford. I therefore terminated the cable/internet to them, to where the first lady had a fit saying it was in the ad. Yet, her bad faith in not paying what she promised to pay for rent has made me reduced payment where I can. I have also had to pay for sewage cleaning services 3 times in the last six months; once for roots and once recorded as grease, which was not from me.
Resolution: I asked owner for help, and he got me to serve them 'illegal residency' paperwork, stating 30 days to leave premises on the 5th of April; for possible eviction procedures if they are not gone by then. I also am trying to get ahold of DHS against them for not paying what their paperwork says they are paying. Both the paperwork and the DHS is against the two women as the man (in the couple) has no documentation connecting him to the house. What can I do to expedite them moving out as I cannot afford the utilities that they are using for free? Would I be able to go to small claims against non-paid rent, or for their portion of utility bills? Anything that has been done wrong?
