    Default Possession of Marijuana Charge for Smoking at School

    My question involves criminal law for the state of: Michigan

    Alright so 2 or 3 months ago I was caught at school after I had smoked weed. Somebody had told the principal. They had searched me and found nothing. No pot, bowl, lighter or anything that could associate with smoking marijuana. Not until recently had I gotten a court order saying that I was in possession of marijuana. Is this right? I had nothing on me when they searched me all I had done was smoke. I don't know if pleading guilty or pleading innocent would be right or wrong. I have the court date in 12 days and I really need help. Thanks for reading this.

    I can't see the "court order" from where I'm sitting, so I have no way to explain it to you.

    You also haven't told us if you confessed to possessing marijuana on campus, confessed to smoking marijuana on campus, and/or were tested for drug use with a positive result.

    If you are charged with possession of marijuana, you need to tell us if this charge is in adult court or juvenile court. You should also identify the statutory provision under which you were charged.

    Sorry for not explaining it like I should have. I had confessed to smoking marijuana to my principals, but we did not smoke on the campus of our school. When I say our I mean me and my friends. There were 3 of us. I had not owned the marijuana. My friend who did own it did confess to owning it so they know it was not mine. I was never drug tested. I'm quite sure it is juvenile court seeing how I am only 15. I'm not quite sure what you mean by statutory provision, but here is a picture of the court order.

    That's a juvenile court petition. Odds are you are going to be offered a resolution of your case that does not involve going to trial.

    If you choose to fight the charge and go to trial, you can try to convince the court that you weren't in possession of marijuana.

    Alright thank you for your help. Just one more question though. What would you recommend I do? Fight the charge or say that I'm guilty? Would I even have a good chance of convincing them that I wasn't in possesion?

    You can make your decision about your approach to the case after consulting with a lawyer who has the opportunity to review the police report, as well as consult the prosecutor about possible dispositions. If your lawyer finds a way to keep your confession out of evidence, and nobody testifies that you had marijuana at school, you could have a triable case; I make no promises about what evidence the prosecutor does or does not have.
