    Default Marriage Fraud

    My wife applied for permanent residence in October of 2004, got pregnant in November of 2004, received her permanent residency in May of 2005, had our 1st born in July of 2005 and left in August of 2005. She filed for divorce in August and lives in the state of Virginia now. I have written many letters to USCIS and they said they cannot do anything. We are still in the middle of a divorce case and she has not submitted a lot of documents for discovery. My attorney says it will not make a difference.


    Should I pursue marriage fraud in civil court or will it be a waste of time? Everyone is telling me to let it go and start over. On the other hand, I cannot live in peace knowing that she is getting away with a crime.

    Where is the fraud? Are you suggesting she married you and got pregnant to obtain citizenship and no other reason? If you want to go that route then you may qualify for anulment and not Divorce!
