Default Modifying Child Support After Taking a Job With a Lower Salary

My question involves child support in the State of: Kentucky

First off I just want to say thanks for any responses that might be able to help address my situation. I currently have a good career and I pay quite a bit of money in child-support. Before I got a divorce I was working on my PhD in software engineering, and I was down to one class and then finishing my dissertation to complete it. All this would take probably around 2 to 3 years to

About one year before my divorce I decided I need a break from school got a good career and my child support is based on my current job. I recently have thought about going back and finishing my PhD. Mainly because it was my dream to be a college professor.

At the moment I am earning nearly 4 times the salary I was making as a teachers assistant now that I'm in the private industry, but I met up with my old professor and after talking a while and making a few trips to the University, they offered me around $34,000 to be a teachers assistant again while finishing my PhD.

If I go down this path I won't be able to afford the nearly $2000 a month I'm having to pay right now in child-support, at least until I finish my PhD and get a new career. Is it possible to get the child support reduced based on my new job? Or are they always going to look at what I'm making right now? Like I said it's impossible for me to pay that much while being a teachers assistant.

    Thank you

Your new job would be considered voluntary underemployment and thus you would be ineligible for a reduction of your support.

Thank you for the reply I was kind of scared that that would be the case.

One last question, would it be possible if I pay her one lump sum before I took the position as a teachers assistant? Since my tuition would be paid for by the university while I'm a teachers assistant I could possibly take a loan out to pay for the child support while I was finishing my education?

Let's say I took a loan out to pay 2 and 1/2 years of child support in advance? This way I could still finish my PhD and still able to pay the child support based on my previous career salary? The reason I'm asking is I really would like to finish my phD, but my current career is very demanding and 12 hour work days are normal.

I don't think I could work were I am at and still be able to put the amount of studying time it would take to finish my degree.

    Thank you again

No - that's not going to work. CS is always fluid; it can go up or down depending on the circumstances.

I don't see why that wouldn't work. After all, your support wouldn't go UP. I wouldn't recommend paying it in a lump sum, I would pay it monthly the same way you do now.

But I do want to say this:

My sister in law is currently pursuing her PhD in microbiology while raising 2 children, caring for a sick husband and teaching. If all you have to do is go to school and work? You should be able to do it. The things you want, you don't mind working hard for.
