    Default What is the possible outcome?

    I recently filed a petition for paternity in Ny on 8/2006 because my ex put out a Bogus order of protection against me to prevent me from seeing my 2 kids. I was seeing the kids regularly every weekend and i was even keeping them for a full week once a month. The return date was 10/2006, in which the judge told me by admitting to paternity i am obligated to pay child support which i have no problem with. The problem is 3 days before the court date I got hired somewhere in which the salary was 25,000 annually but never actually got the job for some unknown reason. I was supposed to start 2 days after the court date. I told the judge my annual salary is 25,000 and I am now unemployed. I did'nt report income tax last year either as i was working "off the books". So in a nutshell I'm not making the money that i told the judge i'm making and i did'nt file income tax last year. What are the possible outcomes of this scenario

    at any time you can request a modification hearing. I would request one and go to court and explain what happened. you will have to pay all support ordered prior to any modification ordered. what I mean is if you were ordered to pay $300 a month in august and at the modification your support drops to $50 a month in december you are still obligated to pay the ammount owed for the previous months but they can order it be paid by $5, $10 or $15 a month so you don't have to come up with it all at once.

    "Gee, your honor, I'm not showing any income for last year because I worked off the books and committed tax fraud. And 'for some reason' I didn't get a job that would have been on the books. So I don't want to pay much support."

    If that's how it would sound, I would suggest instead looking for another real job.

    Well actually"Mr knowitall" I never told the judge i worked off the books. I just wanted to know what would be the outcome of me saying 25,000 when i thought i really got the job. By the way the "real job" you got that takes tax from you actually supports my ex's fradulent welfare activities. meanwhile collecting money from the dad. Give advice but don't be condescending if you DON'T KNOW IT ALL.

    Mr. K's is a well repected member of this forum who's opinion and know how have helped many. His reply was dead one from my view based on the information "you" provided us! Youcame here for "free" advice from persons "unknown". Then you complain. YOU GET WHAT YOU PAY FOR! That being said I feel Mr. K was dead on right. My motto is "If you dont want to hear the answer dont ask the question"

    You seem to think that the judge will be stupid. You've established yourself as having an earning capacity of $25K per year, which isn't particularly impressive for an able-bodied adult of average intelligence, so you can expect that the court will expect you to be earning at least that amount. I was merely pointing out that your argument to the court, "It's not fair that I should be charged child support based on what I am capable of earning" is not going to fly, particularly when you're committing tax fraud - and can't or won't document your actual income because of that tax fraud.

    You're choosing to engage in tax fraud, and that's likely to make it harder, not easier to avoid paying your support. Does that really surprise you?
