My question involves landlord-tenant law in the State of: California

Hello,

In a relatively standard periodic lease with multiple people in a house. The lease does not currently allow for subletting and does not have a provision for paying a fee and leaving the lease.

Due to circumstances at my place of residence, I do not feel safe staying for the entire duration of our periodic lease.
Two of the tenants and their friends are somewhat hostile towards me and continue to either pretend to not remember or actually does not remember previous agreements made between us. They have complained about how I try to do everything through email instead of just talking to them, and then later they come back disagreeing with all of our past arrangements, saying they don't remember agreeing to this or that. I feel like I am getting manipulated and taken advantage of, and as of late, after bringing these issues into light, I feel that they have gotten more aggressive in their hostility. Very recently, furniture in one of the common areas has been broken and no apologies or admission of guilt has been offered. I fear that they eventually may try to enter my room while I am away and do who knows what.

I have about 3 months left on the lease, but I was wondering if it is legally okay (and legally smart) for me to:
  • have the landlord take myself off the lease,
  • agree to cover the rest of my portion of rent until the end of the lease terms if I am given the ability to freely sublet for the remaining time,
  • and then continue to live there in a "month to month situation" so I am in a situation where I am not so legally and financially tied to all of the tenants?


  • What do the laws governing the covering the costs of my remaining rent and subletting say?
  • Can the landlord refuse this and if so what are my options then?
  • If I just "terminate" the lease, what happens if I just stay at the house and continue to pay rent?
