    Default Landlord Reversed Decision to Extend Lease

    My question involves landlord-tenant law in the State of: Georgia

    A few months back all of the housemates had said they would be moving out at lease end, and I told the landlord I would be staying on by myself, which they verbally agreed to. The landlord later demanded that I replace said housemates in order to continue the lease. Midway through the last month of the lease, the landlord decided to refuse extending the lease under any circumstances, has not asked to requalify myself, has not presented new paperwork, or anything. I had contractual obligations that had me out of state much of the last month of the lease, and now that the lease is up the landlord is demanding I vacate or pay rent, with no new lease, nor even a month-to-month agreement, and being told they "already have a new tenant ready to move in"

    I have a lot to move and lot of contractual obligations that will prevent me from devoting a large block of time to moving.

    A written agreement is not required to have a tenancy at will (i.e., month-to-month agreement). Your choice is to vacate, pay the entire rent or face eviction.

    What about the whole "get more roommates before I'll consider extending the lease" issue? Or the refusal to re-qualify myself to write a new lease with me as the only tenant? (The original was created as a co-lessee lease)

    The problem is not whats happening right now, but the backpedaling on extension of the lease and conditional extension requirements

    You failed to meet the contingency before the landlord told you that the offer was no longer on the table.

    If the landlord does not believe you are capable of paying the rent as the sole tenant, the landlord doesn't have to take the chance.

    Quite obviously, if you are unprepared to continue to pay rent you are going to be evicted. It's not clear that the landlord is going to give you the boot if you continue month-to-month, but if you refuse or fail to pay your rent on time you're simply reaffirming that he made the right call when he decided to decline the lease renewal.

    Im not unprepared or unable to pay on my own. I made my intentions clear, in writing, during the required period to renew.

    I'd just like an offer on the damn table before being told no, or only on condition.

    The landlord is refusing to accept my application is what it boils down to. Theres no contingency in the lease that x number of people have to occupy to qualify for leasing.

    what, if anything, does the lease say regarding the expiration of the lease? Does it require a notice of any sort to either continue or terminate the lease? Does it self renew? Does it convert to a month to month lease?

    did your landlord provide you with any written notice of the termination of the lease or refusal to renew it or anything else?

    Provide an accurate timeline as to the notices in regards to the expiration of the lease..

    that may be true but that does not mean he has to rent to you. He does not have to accept you as an individual tenant whether you can qualify or not.
