My question involves a consumer law issue in the State of: TEXAS
this is a long story that I will try to short for you. I bought a phone from virgin mobile on feb 17th. 4 hours later I called to return the product. return was processed, and was told it would take 7-10 days to go back to my card. Feb. 20th told it was still processing, I called again on the 1st and told to give it 3 more days. called again on the 4th, they said then that the product was delivered on the 18th and thus I couldn't have a refund. calling fedex I learned that it was at my office, I got it then had to go through the better business to get it returned as they said it was out of the return period. Finally by the 15th I was given the address to return the phone to them for a full refund. Better business marked it as closed, on the 17th I mailed the phone back to them with tracking, insurance and signature required. It arrived at their facilty on march 20th at 12:20pm, I called and left several messages for the lady who said I could return it. After not being able to get ahold of her for almost a week I called on the 27th and demanded to talk to someone and got ahold of her supervisor who said that he didn't have the tracking number to find the package, so after giving it to him. (it was on the better business emails, and I had given it to the lady previously) He said she would call me back that day. She never does, and I called them back on the 28th. They said that they had not located my package in the facilty yet and would ask for an update every 48 hours. I kept asking for a day that we will do something else if they can not locate the device and she said once 2 weeks that they would look at alternatives, but when I asked her to confirm that then she said that there is no time frame that she can give us. I filed a claim through paypal, but they said that unless I can prove somehow that they actually received the item they wont refund as its for almost $700. I am on hold with usps to try to get a copy of the signature to send to paypal along with a copy of the shipping label to appeal the claim.
This has been a purchase from hell, I have changed phone providers due to this. But as of right now I don't know anything else I can do.
any ideas or advice would be greatly appreciated.
the better business was through Missouri, and I had to ship the package to Indiana. I am located in Texas
