Nothing was signed and I was not notified at all. I found a facebook post by the mother yesterday, and today called the vital records office and they said, "Yes the name has been changed"

I am as baffled as you are because everything that I have read states that I would have to consent to it, and I would also have to be notified of the change. So I am assuming from here, its just finding a lawyer to figure out how she was able to do this?

No, that doesn't make a difference. It would still take a court order to change a child's last name.

Now, what could have happened is that she got the court order before you were established as the father, but just got around to changing the name with the vital records division.
