    Default Received a Red Light Violation Through Camera Enforced Signal

    My question involves a traffic ticket from the state of: MO
    Received a Red Light Violation through Camera Enforced Signal.
    There was -no turn on right sign, and signal was red for the right.
    But for the straight moving traffic was having green arrow.
    I have received this ticket in St Louis, MO.
    I have following questions :
    1. Will there be any points on my driving record?
    2. Can i fight this ticket?

    I was cited for truning right. I received ticket in St Louis City near Central West End neighborhood. Court - St Louis Municipal Court , Downtown - on Market Street.
    for violation of - Traffic code sections : 17.07.040 and 17.08.130
    ORD 90121990.
    Traffic signal - NB S Skinker BLVD @ Forsynth Blvd / Lagoon DR

    Sounds like its a valid citation, doesn't it?

    And there is no requirement to have a no turn on red sign. When the signal for your intended movement shows red, you must stop as required. THEN if there is no sign prohibiting a turn on red, then you can proceed after checking cross traffic and pedestrians in the adjacent crosswalk.

    17.08.040 Official traffic-control devices--Presumption of legality.

    A. Whenever official traffic-control devices are placed in position conforming to the requirements of this chapter, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence.

    B. Any official control device placed pursuant to the provisions of this chapter shall be presumed to comply with the requirements of this chapter unless the contrary shall be established by competent evidence.

    17.08.130 Traffic-control signal colors and terms--Steady red indication.

    Vehicular traffic facing a steady red signal alone shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then before entering the intersection and shall remain standing until an indication to proceed is shown. After stopping, a driver may cautiously enter the intersection only to make a right turn unless a sign at such place prohibits such movement and shall yield the right-of-way to pedestrians lawfully within the adjacent crosswalks, and to all other traffic lawfully in the intersection or about to enter the intersection.

    "Disobey Traffic Cont Device" which stands for "Disobeying a Traffic Control Device" when cited as a municipal code violation is listed HERE: Missouri Department of Revenue - Missouri Driver Record Traffic Violation - Descriptions and Points Assessed as a violation that carries 2 points. (See page 2).

    You can certainly fight it. But to expect to fight it and win, I am not seeing anything that implies you have a chance, not based on what you posted.

    No, its inconceivable to expect me to list each and every qualifier that would make this citation invalid or would present you an opportunity to fight it. Here is a link to the municipal ordinances regulating the use of such a system. Read through them, do some research, think up some questions and come back to ask.
