    Default Can I Sue My Ex-Girlfriend For Claiming I Committed Domestic Violence

    My question involves defamation in the state of: AK
    A girl that I used to be friends with was going around telling people that I'm being charged with domestic violence which is not true. There is a pending case but there are not gonna be any charges on me because I haven't done what they said I did. She also told them I'm having a misbehaved dog who bit me badly and I had to go to the hospital. He did hurt me on my knuckles BUT this happened by accident while I was playing with him and tried to take the rope out of his mouth. All I told her was that my dog was acting up at the time because my husband has been gone for a week. I never went to the hospital though. And she is saying that everyone who allows their dog near mine is putting him/her in a bad position. That whole thing is hurting my business because I just started a pet sitting business and now people are looking at me like I'm insane because of her false statements. She put this lie out in public by commenting on a status on a group page (Facebook). BUT she did not mention my name, it is obvious though that she is referring to me because I am the only one who started this kind of business a few days before the post. Yet I know for a fact that she did mention my name when she was talking to some people in private and one lady approved that it was about me and said that she has heard things from another lady (that I never talked to).

    Is this enough evidence to sue her for libel? I tried to talk to her and wanted to give her the chance to clarify everything but all I got from her was that she never did anything wrong or illegal and that she has never mentioned my name or lied about anything. Which is obviously another lie. After this I was blocked from her page and did not get the chance to respond to her at all.

    You only have a case if what she's saying is untrue.

    She says you're being charged with DV and you say there's a pending case. So what she says is true.

    She says your dog bit you and you say your dog bit you. So what she says is true.

    She says you went to the hospital and you say you didn't. So this is the untrue part, and the only bit you can use as a basis for a lawsuit. You will need to prove that whatever damages you've sustained are a direct result of the "went to hospital" statement, and no other statement.

    If you have a pending criminal case of Domestic Violence then you have been charged, you are confusing charged with convicted.

    Defamation and Libel are notoriously difficult to prove and would cost you thousands of dollars ( not just 1 or 2) and years of your life over facebook posts.

    Of course in addition to being knowingly (or recklessly) untrue, it also needs to be in writing. Slander on the other hand....

    Louis Nizer has a nice saying about this. Consider most slander/libel to be like mud splashed on your coat. You can go ahead and try to attack it immediately, smearing it around making a mess that will take forever to get rid of. Or you can wait a bit until it dries up and easily flakes off and brushes away.

    Hey everyone, first off I apologize for the late answer. I haven't really had the time to respond. Well now things have changed. Yesterday I was informed by a friend that there is another Facebook post.. Ugh! Well in this one my name was mentioned, supposedly my husband beat the s*** out of me, I was harassing the girl, her and her husband bailed me out of jail on top of that they brought my dog into the picture again and said he attacked her friend's dog which she claims as a lab/boxer mix but is actually a pitbull. None of these things happened and I'm really getting tired of it. Isn't there anything I can do? I noticed the answers stating that it costs thousands of dollars etc. but she just won't stop. And everybody of course believes in her and her friends words.

    If you have money to throw away you can contact a lawyer. If you don't then I suggest blocking her on facebook and addressing the fact that her claims are false if and when the claims are brought up to you.
