My question involves an eviction in the state of: MD

This question is to figure out what charges can be applied to resident's ledger upon move out due to a skip for non-payment of rent.

Example:
  • Rent is due March 1.
  • Grace period until March 3.
  • Rent unpaid. Landlord files on March 4.
  • Landlord requests $1000 in past due rent and $50 in late fees. Landlord wins judgement on March 17.
  • Judge provided tenant 1 week to pay rent. Resident understands he's unable to pay and vacates unit on March 21.



Warrant of Restitution not issued because the tenant has vacated the apartment. Landlord wants to turn the tenant over to collections.

Example Lease States:
  • Resident must provide 60 day notice to terminate lease early.
  • Early termination results in re-letting fee equal to 2 months rent.



Landlord wants to sent resident to collections for the following.
  • Past due rent + late fee = $1050
  • Fulfillment of 60 day notice = $2000
  • Termination fee @ 2months = $2000



Total sent to collections: $5050 + court filing cost.

Is the above collection's total correct. Can a landlord send to collections for $5050, when the landlord was previously in court suing for $1050? Does it make a difference whether the tenant leaves on their own, or tenant is forced to vacate from the Warrant of Restitution?
