    Exclamation How to Get a Shoplifting Charge Dismissed

    My question involves criminal law for the state of: North Carolina

    I'm 18 and I was caught stealing at a walmart (yes I know)
    for a total of $25 and some change. I have a court date for the 14th of april, I was reading up and noticed a program called cognitive behavioral international program, if I take it will the case be dismissed? I don't have an income and I would just like to get this over with and I would be very appreciative to anyone who could help keep this of my record. it is my first ever offence and I definitely learned my lesson. I had a long conversation with the lady who caught me and I even thanked her for doing so. I've never been to court and any information would be appreciated. I just don't want this dumb mistake to affect my future.

    CBI is a deferral program. You ask the court to allow it and if you take the course and pay your fees your case will be dismissed.
    I still recommend a lawyer to get this approved by the court. It's not a lock.

    You can ask for a PD at your arraignment (first court date). Plead not guilty and ask for a PD.

    Before your court date: Look for work and be able to prove it should the judge ask for proof (date, position applied for; applied in person/email/internet, etc). This shows the judge you are putting in effort.

    Expect a letter in the mail from Walmart/their lawyer asking for money....it's a debate as to pay it or not...

    even if I am guilty I can still plead not guilty? is this for a plea bargain?

    Yes, you may plead Not Guilty. It is your right. If you qualify for a PD, you can discuss any kind of plea deal with them.
