    Default Landlord Entered My Apartment for a Non Emergency Maintenance Without Notice

    My question involves landlord-tenant law in the State of: Washington

    Hello!

    I came home after spending a day away from my apartment to find it had been entered and non-emergency maintenance had been done. I did not receive notification prior to this happening. Once i spoke with a neighbor, they stated they received a notice taped to their door.

    I have not spoken with the manager yet, but i was wondering if a note taped to the door constitutes notification in accordance with RCW 59.18.150? If that is considered notification, does the 48 hour rule apply from when its placed, or the day after it was placed? Ultimately, I'm looking for a solution that will benefit all involved parties.

    We are away from the apartment often and i would like to know what i can do to make sure i am aware of what is happening in my home. It felt like my privacy had been invaded when i realized that someone was in my home without my knowledge.

    The statutory requirement is not "48 hours notice", but is two days written notice. A typical interpretation of that type of language would be that any reasonable notice within normal business hours would be good for entry two days later during regular business hours. The requirement of written notice would be satisfied by the posting of a notice on a door, and it would be reasonable in most cases for a landlord to believe that a tenant would receive such a notice on the date of posting. With some complexes, the task of providing personal notice to every tenant for a routine repair would be daunting, and notice by mail can complicate things by creating questions of when the notice was received. The manner of notice may be described in your lease.
