    Default Can You Sue Somebody Over Detention if Your Criminal Charge is Dismissed

    My question involves civil rights in the State of: PA

    who can you sue if you sat in prison for 180 days and was found not guilty of a crime and the charges were dismissed due to NO evidence. do you sue the person who wrongfully accused you, do you sue the police for not conducting a full investigation before charging you with a bogus crime? do you sue the police for no line up, do you sue them for not telling you that you had the right to an attorney before appearing in front of a judge? do you sue the state for compensation of sitting in jail after being wrongfully accused and charged? how do you get compensation for all of this? lost job because of waiting to go through the legal process. cops lied on the stand which they were caught doing.............do you just write it off as nothing happened in your life?

    In most cases you won't have a lawsuit against anybody. The rest depends on the facts. As you have shared no relevant facts, you will need to discuss the case with a lawyer in your state.

    Were you found not guilty or were the charges dismissed?

    Either way, having charges dismissed or being found not guilty does not equate to you being actually innocent nor does it mean you were wrongfully accused. It means the state failed to meet the burden of proof required to prove beyond a reasonable doubt that you committed the crime.

    In terms of proactive steps you can take, counseling is recommended and there may be free resources to help you process what happened. You could also consult an attorney with the specific facts of your case to determine if you could take any legal action against the people involved. You might start by asking this question of the attorney that represented you.

    Finally, why didn't you post bail?

    What do you mean by "wrongfully" accused you? That alone would probably remove responsibility from the police. The accuser? That depends on more facts.
