    Default Filing a Tax Return When Your Spouse Isn't Documented but Has Income

    My wife had a temporary green card in 2013 for 10 months but expired by the end of the year and was denied citizenship. She worked for a couple mouths at that time.

    Would I still need to apply for ITIN# for her for that year? Or would it be ok to just list her SS# when I fill out my 1040 form?

    I know that if I filled jointly, I will not be entitled to any EITC. But since Im filling separately, would I obtain EITC or any refunds?

    sorry, temporary ss card. We got married and applied for citizenship, we received a temporary ss# card that expired in one year.

    That still doesn't make sense. Your wife would have to have a green card for 3 years before she could file for citizenship based on marriage. I have also never heard of a temporary SSN. Has anyone else?
