    Default Will I Have to Pay Child Support Arrears if I Didn't Know the Mother's Address

    My question involves child support in the State: TN

    Shortly after my son was born in 2000, the mother moved and didn't tell me where. I found them after 6 years. I was giving her money once a month. In 2010, she moved again withou telling me. I mailed her check, but the check was mailed back. Now I recieve a letter stating that she wants to put me on child support. I know she doesn't have to tell me whenever she moves. My thing is I feel that shouldn't have to pay arrears because she didnt allow me too. The only thing that I can prove to back that up is she had 10 different address in 2 years and 4 different numbers. I know she is allowed to move and get her number change. I'm saying this shows that's she was always moving. I can also prove payment for the time she was around. I can only imagine that amout they will make me pay. Will a lawyer help in matter?

    On this one, you NEED an attorney. TN allows for retroactive support all the way back to birth. BUT - the code also opens the door for rebuttal.

    I contacted a few and 1 wouldn't answer any question. She offer to give me an 1 hour consultation for $300. The other one said it doesn't matter if she didnt matter move and don't allow me to provide support. I don't think this is fair. How can I provide support for my son when the mother didnt allow me too, but I guess that's the child support system.

    What I normally see in situations like this, is that you knew you had a child, whether or not you had an address....

    You should have put money away monthly in a savings account for the child, in case she did pop up...

    Besides unless the money goes through the courts or CSE, any money that you gave her is typically seen as a gift...

    The law doesn't really care about your reasons - generally the court expects you to actually know where your child is, and expects you to take action to find your child if you don't know. You could have used a TN child support calculator to roughly estimate the monthly amount and opened an account just for that.

    I know this isn't what you want to hear, but it is what it is.

    I understand. I did a lot if thing to try and find her, but nothing I could prove. I feel that the way the child support system is designed nothing I would have done would have good enough. The lawyer said i would get credit for the stuff I done. The good thing is at least I have my son back in my life. His mother is very hood and he is started to act that way. Hopefully, I can change that.

    I do hope you can resolve this. If the attorney isn't familiar with these types of cases (where a retroactive order is actually the default and requires a rebuttal in order for the court to deviate from the default) you need to find one who is.
