    Default How Much Child Support is Too Much

    My question involves child support in the State of: Illinois

    Ex has files motion for modification of child support. Current amount is $45/wk support plus $20/wk towards day care. This was based on my old income. I am now making close to $300/wk. ex caught wind of it and is now asking for modification plus now half of her day care costs that she says are over $500/wk for 3 kids. If a judge grants that, I will have nothing left of my checks. How likely is this to happen? In her motion, ex says it should becaus I have no living expenses (live with parents). She makes plenty of money. Why should I have to pay day card just so she can continue to make more money than me?

    Illinois figures CS by a percentage of the NCP's net income. Mom's income won't come into it.

    I get the 32% part. My bigger question has to do with day dare. Will a judge really make me pay half in addition to child support?

    Depends on your judge.

    What expenses does child support cover?

    Child support payments cover the basic needs of the child such as food, clothing and shelter. Child support payments do not necessarily include expenses related to education, medical/dental costs, extracurricular activities or daycare. A court may order that the payor pay additional amounts for these or other child related expenses.

    The first thing I noticed is that you haven't once mentioned your child or the child's living expenses.

    Strange, that.

    There is no hard or fast answer to that question. If you can't afford more child support or daycare, you need to review your circumstances because the court doesn't care about your expenses.

    Absolutely! Mom has to work to contribute to the upkeep of your (mutual) child. If she doesn't work, then the child doesn't eat or have a place to live. Child care is part of taking care of a child.
