    Default Can the Police Search Your Trash Without a Warrant

    My question involves criminal law for the state of: Nebraska

    A warrantless search of trash, and 3 informants statements over 9 months old issued search warrant. What will support the suppression of evidence? Can an individual show good cause, for reasonable aspect of privacy of own's garbage to suppress evidence? List below is the personal reason for aspect of privacy, and listed facts from affidavit.

    Going through ones trash for evidence is quite common. It's also used by Identity Thieves to find any info they can about your bank accounts, credit card numbers, etc,.

    As for reasonable expectation of privacy... once it's on the curb/or the trash can is on the curb, the police can take the bags. Now, taking it from INSIDE your home is a different thing, that they need a warrant for.

    Yep. Once you set it curbside, anyone, including the police, can take your trash and use it for whatever purporses. When I was dispatching for a little city PD, the vice unit from the sheriff's department used to come into the lobby in the middle of the night with tarps and rakes to go through trash they'd collected from suspects. The ladies in records could always "tell" when they came in the next morning with wrinkled noses.
