    Default Can You Be Charged with Theft Over an Online Gaming Account

    My question involves a consumer law issue in the State of: my cousin whom lives in texas plays clash of clans on the iPhone. His friend gave him his account and my cousin spent money on his account and later decided to sell it on ebay because he no longer plays the game. the kid is now trying to re obtain the account and said that my cousin took it from him. According to the terms of service for the game supposedly the company who host s the game own the rights to each individual account. for it to be theft don't they have to prove that you were intentionally deprived of your property? also because the accounts are owned by the company that host the game on their servers, my cousins friend never had rights to it in the first place correct?

    hers a link to their terms of service. believe its 2.2 on their document within the rights of the account.

    For all we know, your friend could go to the police and report that you hacked his password and stole his account. What the police will find and conclude if and when they investigate, we wouldn't be able to tell you.

    not possible. my cousin could not get in trouble because the other guy had no rights to the account in the first place, meaning its not his property.

    section 2.2 of the going companies policy states:
    2.2. Accounts
    NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF SUPERCELL.

    my cousins friend would have a craps shot at best for claiming theft because the legal definition of theft requires you to prove that the other person intentionally knowingly deprived you of your property, which is this case the kid has no rights to the account but the gaming company does.

    You are very confused about the crimes that can be charged for illegally accessing or transferring somebody else's online account, whatever the TOS say about ownership.
