    Default Ambien Lawsuits

    I recently started seeing reports about Ambien lawsuits online. I contacted an attorney about an incident and am waiting for an investigator to contact me. The attorney's office thinks I have a case, but they really didn't tell me much. I told my story to one of the partners, who then had me give all my information to someone else. I'm not sure if the woman who took my information was a paralegal or what, but she didn't have much info for me. I was just told that they thought I had a claim and that the investigator would call me in 7-10 business days. I have never been part of a civil lawsuit, so I am not sure how any of this works, but I have a few questions I would like to have the answer to before I speak with the investigator.

    My story is this: I was taking Ambien for several months. One night my husband was working night shift and I was home alone. I was sitting on my couch talking to someone on the telephone at around three in the morning, and the next thing I knew my husband was trying to wake me up. I was in our home office, passed out in a puddle of vomit, sitting at our desk. I was hurting all over, and had absolutely no clue what had happened to me. It was 8 a.m., so I had 'lost' about 5 hours of time. My forehead was bruised, hurt, and felt numb over my eyebrow. The worst thing was, my privates were hurting really bad and I couldn't imagine why. I felt like I had been beaten and raped, and I was terrified. The only reason I KNEW that I hadn't been raped is that we have dogs, and I know that no one would have been able to get in my house and attack me without the dogs attacking them. If a stranger had come in my house I would have either found a dead body or a signs of a bloody attack. My dogs go crazy when someone comes in the house. There has been a few times that someone has come in that they know, but I have been asleep or have been in my bedroom. My English Bulldog, Chumley, bows up to about twice his normal size and starts growling really deep and low. Even though he knows the visitor he will not allow them in the house when 'mommy' is asleep or in bed. He is wicked protective of me. When my husband found me unconscious at the desk, Chumley and our other, older dog DOG (a chow mix) were seated at my feet, 'guarding' me.
    Anyway, I was confused, ashamed, and felt 'dirty', just like a rape victim. I was terrified because I had no idea what happened, but it was obvious that something violent had occurred. My husband was alarmed and upset as well, afraid to leave me home alone. He took me to the doctor who performed a gynecological exam to find out why I was hurting so bad. He actually found an area of necrotic tissue on my labia, caused by severe trauma. I had also 'killed' a nerve in my eyebrow. The only scenario we could piece together based on the injuries I sustained, is that I must have been sleepwalking and ended up in the office. Once in there I must have had a seizure and while I was seizing, I apparently fell straddled on the arm of the desk chair, which caused the trauma to my labia. Then I must have fallen, face first, onto the desk, hard enough to cause the nerve damage to my eyebrow. Now, the injuries have since healed, but I remain psychologically traumatized by the incident. I am afraid to take any sleeping pills while I am home alone, even though I suffer from severe insomnia. My sex life suffered as well.

    My question is, in cases like this, how much money do they usually ask for? I'm not trying to get rich or anything, but I don't want to have to relive all of this and go through a bunch of drama if it isn't going to be worth it financially. Also, how long does this type of thing take to go to court?

    Any help would be appreciated.

    This could be a problem, in that it is a misuse of your medication. Ambien is a medication you take to sleep, not to talk on the phone. Take it and don't go to sleep, and you run all sorts of risks, including a Patrick Kennedy-type car crash. It's not sleepwalking if you never go to sleep - it's much like being drunk but without the alcohol-related sickness feelings and with a significant likelihood of memory lapses or loss. What did the person on the other end of the conversation have to say about how the conversation continued and ended, past the point where your memory stopped?

    With no offense intended, that's a rather far-fetched scenario. Do you have a history of seizures? Seizures are associated with sudden withdrawal from high doses of Ambien but I've not heard of their being associated with normal usage, and if you have no history of nausea or vomiting with Ambien it seems unlikely that this was a coincidental one-time incident of nausea from that medication. I note that but for the dogs, even you would be assuming this to be a sexual assault, which still seems to be the most likely explanation - would your dogs chew family friends they are familiar with to pieces as well? Could this have in fact been an assault by somebody who knew your husband was away and also knows your dogs? Or somebody you invited in while under the influence of Ambien? Was a "rape kit" used by the doctor to collect evidence of a possible sexual assault?

    How far are you off of your peak morphine/oxycodone usage? You were at a staggering level this spring. If you are still on high levels, or even if they are much more moderate, it may be difficult to separate out the effects of the opiates you take from effects which might be attributable to Ambien.

    I have to say I have taken Ambien for years and I have never encountered any problems. I take it want I am alone as my husband is often away doing his job. I have no fears of injury when taking it. I take it 1 to 2 hours before going to bed. I have even taken it just before taking a shower. No problems. When I take it I either break a pill in half to get 4 hours of solid sleep or a whole pill and will still only sleep for about 4 hours.

    As for the injuries to your labia. I have a guard dog that has been trained to kill and yet my brother came to visit, walking into my home, petted my dog, played ball with him and made himself at home while I was at work. My dog did not so much as growl at him nor has he ever met my brother as he was here visiting from another state. Now my step-sons can't even get passed the security gates without my dog wanting to kill. I would really investigate the fact that you may have been raped.

    TJ, Ambien is a hypnotic and if you combine a hypnotic with narcotics/opioids you are fortunate you didn't go into a coma. What dosages of other meds are you taking with Abien?

    They are related as are their posts on other forums which would affect an attorney taking their case, things that will come out in litigation.

    I was on Ambien for a short while. I quit taking as I am a known sleep walker and one night, I walked outside in my underwear and fell down, breaking two fingers.
    One of my neighbors guided me home and in the process of going inside, I fell off the steps landing on my left shoulder, tore a rotator cuff or cup {whatever that is}.
    I awoke next day very sore and embarrassed. Never felt any pain during the falls, only the next day.
    I quit taking it then
