    Default How long can someones trial be delayed?

    I know someone who's been in custody in a correctional facility in Nassau county for more than 6 months and their trial keeps being delayed.

    Can this be violating their 6 amendment in New york state,since the D.A. cannot directly link the evidence to the person in custody?

    If anyone has any knowledge in these situations,send me that response..

    Presumably this person is being represented by counsel. Assuming that the delay is the fault of the prosecutor, the attorney should make sure that this person's speedy trial rights are observed.

    I would also check your state/county laws. You are entitled to a speedy trial. In Washington, they give you 90 days until your trial, that's considered a speedy trial, unless the crime is a Felony, then they can push it back a few times if they need time to get a case against you. Most places have to give you a speedy trial, if they don't you can get the whole case looked at, and possibly dropped or something.

    Look at your states Revised Code, that could tell you what you need to know, or a local Criminal Defense Lawyer, he/she would also know for sure.
