    Default Finger printing after the charge

    This is in Ohio.

    My friend was charged with domestic violence over one week ago. At the time the police officers had forgotten to finger print him. They are now saying that he needs to come back so that they can do it.

    Is he legally bound to come back to be finger printed?

    For any that can speedily help, thank you.

    I would not think that he would have to respond to the law enforcement agency's demand to be fingerprinted since they released him without being fingerprinted but my guess is that if the law authorizes fingerprinting for this offense, which many states do for a felony or violent misdemeanor, then the police may be able to enlist the prosecutor's help and get a court order compelling the fingerprinting anyway. I've also seen it where law enforcement sometimes waits and does the fingerprinting later on provided the defendant pleads guilty or is found guilty although it is usually only an arrest that triggers the fingerprinting. Also, sometimes in the prosecution of a case the prosecutor will seek a court order for fingerprinting and the like as an aid to help prosecute the case, especially if they think fingerprint evidence may help prove that the defendant is guilty of the offense with which he is charged.
